The franchisee will engage in the opening and operation of a fitness and weight loss studio under the Contours Express® trademark and system of operating procedures. The franchisee will operate the business from an approved location, which is customarily located within the confines of a retail strip center or freestanding building.

The initial franchise fee for individual unit franchises is $14,000. The estimated initial investment required for individual unit franchises ranges from $42,300 to $73,820.

RISK FACTORS:

1.    THE FRANCHISE AGREEMENT PROVIDES THAT THE FRANCHISOR HAS THE RIGHT TO SUE FRANCHISEE IN KENTUCKY FOR SUMS DUE IT, FOR MATTERS AFFECTING ITS RIGHTS RELATING TO ITS TRADEMARKS AND CONFIDENTIAL INFORMATION, AND FOR PRELIMINARY INJUNCTIVE RELIEF. OTHERWISE, THE FRANCHISE AGREEMENT REQUIRES THAT ALL DISAGREEMENTS BE SETTLED BY ARBITRATION IN KENTUCKY.

OUT OF STATE LITIGATION AND ARBITRATION MAY FORCE YOU TO ACCEPT A LESS FAVORABLE SETTLEMENT FOR DISPUTES, IT MAY ALSO COST YOU MORE TO LITIGATE AND ARBITRATE WITH US IN KENTUCKY.

2.     THE FRANCHISE AGREEMENT STATES THAT KENTUCKY LAW GOVERNS THE AGREEMENT AND-THIS LAW MAY NOT PROVIDE THE SAME PROTECTIONS AND BENEFITS AS LOCAL LAW. YOU MAY WANT TO COMPARE THESE LAWS.
